The Blender Bytes Quiz GIVE-A-WAY ("Give-a-way") starts at 6:00 am (EST) on February 1,2008 and ends at 11:59 pm (EDT) on February 29,2008 (the "Entry Period"). The sponsors of this Give-a-way are Access 360 Media, 1255 Electric Ave., Venice Beach, CA 90291, "Access 360 Media", Blender, 1040 Avenue of the Americas, New York, NY 10018, "Blender", and Journeys, 1415 Murfreesboro Rd., Genesco Park, Nashville, TN 37217 "Journeys" (jointly and individually, the "Sponsor"). The Give-a-way shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein. Certain restrictions may apply.

ELIGIBILITY: This Give-a-way is open only to legal residents of the United States. To be eligible, entrant must be at least thirteen (13) years of age or older as of date of entry. Employees and their immediate families of Sponsor, their respective affiliates, subsidiaries, parent and related companies, officers, directors, contractors and agents (collectively, the "Promotion Parties") and those living in the same household of any of the above are not eligible. All Federal, state and local rules and regulations apply. Void where prohibited or restricted by law.

HOW TO PARTICIPATE VIA TEXT MESSAGING/ MOBILE PHONE: Beginning at 6:00am (EST) on February 1, 2008 and continuing during the Entry Period Use your Mobile Phone to text message your answer either GYMA,GYMB,GYMC, GYMD, PBJA, PBJB, PBJC, or PBJD to 44264, and follow instructions to register for the Give-a-way. Upon receipt of your text message, you will receive one (1) entry into the Give-a-way. You may only enter the Give-a-way one (1) time. Multiple entries will not be honored. HOW TO ENTER VIA MAIL: You may also enter by mail by hand-printing the words "Blender Bytes Giveaway" on a 3" x 5" card and include your name, address, phone number, date of birth and e-mail address. Automated entry attempts will be rejected and may result in disqualification. Mail entry to: Access 360 Media, 578 Washington Blvd., # 852, Marina del Rey, CA 90292. Your entry is deemed submitted upon receipt of your mail-in. Entries will be disqualified if they contain any inappropriate material or language, including profanity. Give-a-way begins 6:00:a.m. ET on February 1, 2008, and ends 11:59p.m. ET on February 29,2008 (the "Give-a-way period"). All mail-in entries must be postmarked by February 29,2008 and received by March 7, 2008. You may enter the Give-a-way one (1) time. Multiple entries will not be honored.

REGARDLESS OF ENTRY METHOD YOU MAY ENTER THIS GIVE-A-WAY ONLY ONE (1) TIME. MULTIPLE ENTRIES WILL NOT BE HONORED. ALL TEXT ENTRIES MUST BE RECEIVED BY 11:59 P.M. (EDT) ON THE LAST DAY OF THE GIVE-A-WAY February 29, 2008. ALL MAIL IN ENTRIES MUST BE POSTMARKED BY February 29, 2008 AND RECEIVED BY March 7, 2008. Proof of mailing entry, texting entry or entering information at Entry Site is not considered proof of delivery or receipt. Illegible and incomplete entries disqualified. All entries become property of Sponsor and will not be acknowledged or returned. False and/or deceptive entries or acts shall render entrants ineligible. By registering to enter Give-a-way, entrant affirms that they have read and accepted these Official Give-a-way Rules. The laws of the United States apply to and govern this Give-a-way and any claims must be raised and resolved in the United States. Any information collected by registering to enter the Give-a-way shall be used only in a manner consistent with these Official Give-a-way Rules.

PRIZE REDEMPTION: Each participant will receive one (1) code valid for 3 song downloads at www.emusic.com/blenderbyte. By entering and/or accepting the code, each participant hereby consents (except where prohibited) to the reasonable use by Sponsor of the Participants name and age of the without any further compensation for any future promotional activity related to this Give-a-way. No substitution by the participant, for any offer, will be permitted. Lost codes will not be replaced. Codes may not be exchanged and have no cash value. Codes valid for 7 days once redeemed. Codes expire 12/31/08.

AVAILABILITY OF PRIZES: This Give-a-way is limited to the first 5,000 unique participants in the promotion. At the sole discretion of the Sponsors this number may be raised, but not reduced.

LIMITATIONS ON LIABILITY: Releasees shall not be liable to Participants or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Releasees' sole control.

GENERAL: By entering this Give-a-way, entrants agree that Releasees shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Give-a-way or acceptance of or use or inability to use the prize or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Winner releases the Releasees from any and all liability and responsibility with respect to the prize (including any property loss, damage, personal injury or death). Winner acknowledges that the Releasees have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prize.

If for any reason, this Give-a-way is not capable of running as planned, or if this Give-a-way or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Give-a-way and processing of entries per these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsor's sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Give-a-way, Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action, and/or to cancel, terminate, modify or suspend this Give-a-way or any portion thereof. In the event this Give-a-way is canceled, terminated, modified or suspended, Sponsor reserves the right to conduct a random drawing to award the prize from among all eligible, non-suspect entries received before the time of the action or event warranting such cancellation, termination, modification or suspension. If such cancellation, termination, modification or suspension occurs, notification will be posted at www.popbandit.com/blender.

CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVE-A-WAY IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Where a dispute arises about who submitted a text or on-line entry, the entry will be deemed submitted by the authorized account holder of the cell phone or e-mail account entered. The authorized account holder is deemed the natural person who has an account with the cellular company or is assigned to an e-mail address by an Internet access provider, service provider, or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the cell phone number or e-mail address associated with the winning entry and that all eligibility requirements are met.
